**Terms and Conditions (T&C) of Kiss Caribbean Vacations S.R.L.**
1. **Scope**
These Terms and Conditions (T&C) govern the contractual conditions between Kiss Caribbean Vacations S.R.L. (hereinafter referred to as the "Landlord") and the tenants (hereinafter referred to as the "Tenant") of holiday apartments and other accommodation services offered on the website.
2. **Conclusion of Contract**
The rental contract between the Landlord and the Tenant is concluded upon the confirmation of the booking. This confirmation is sent to the Tenant by email after the booking is received. By accepting the confirmation, the Tenant agrees to these T&C.
3. **Rental Property and Use**
The rental property is handed over in the condition described on the website. The Tenant is obliged to treat the rental property with care and to report any damages to the Landlord immediately. Subletting is only permitted with the written consent of the Landlord.
4. **Payment Terms**
The total rental price is to be paid in accordance with the payment methods specified on the website. A deposit may be required to confirm the booking. The remaining balance is to be paid before arrival or at the latest upon arrival unless otherwise agreed.
5. **Cancellation Policy**
Cancellations must be made in writing via email. The cancellation fees are as follows: - Up to 30 days before arrival: full refund - 29 to 14 days before arrival: 50% of the rental price - Less than 14 days before arrival: no refund
6. **Check-in and Check-out**
Check-in is from 3 PM, and check-out is by 11 AM unless otherwise agreed. Deviations from these times are only possible after prior arrangement.
7. **Landlord's Liability**
The Landlord is only liable for damages caused by intent or gross negligence. The Landlord assumes no liability for the personal belongings of the Tenant.
8. **Tenant's Liability**
The Tenant is liable for all damages caused to the rental property by the Tenant or their accompanying guests.
9. **House Rules**
The Tenant agrees to comply with the applicable house rules of the rental property. In particular, quiet hours must be observed.
10. **Data Protection**
The personal data collected during the booking process will be used exclusively for contract processing and will not be passed on to third parties unless required for the fulfillment of the contract.
11. **Jurisdiction and Applicable Law**
All disputes arising from this contractual relationship are subject to the laws of the Dominican Republic. The place of jurisdiction is Higüey.
12. **Severability Clause**
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
